Terms of Service

Effective date: September 14, 2026

Review notice: provisions marked for founder or attorney review below remain draft and require confirmation before these Terms are finalized.

Acceptance of Terms

These Terms describe the conditions for using Kazzera. By using the service, you agree to these Terms to the extent permitted by applicable law. If you do not agree, do not use the service. If you use Kazzera for a business, you must have authority to act for that business.

Our Privacy Policy explains how we handle information. Additional terms may apply to particular features, such as participation in delivery services, when presented to you.

What Kazzera Is

Kazzera provides a marketplace connecting customers with independent local food creators. Creators can publish products and limited-time food drops, and customers can discover creators, place orders, and arrange available pickup or delivery. Kazzera provides tools for payments, communication, and fulfillment coordination.

A listing on Kazzera does not mean that the creator is a Kazzera employee or that Kazzera prepared the food.

Accounts

Provide accurate account and contact information and keep it up to date. Use only accounts and payment methods you are authorized to use. Keep your sign-in credentials secure and contact us if you suspect unauthorized access.

Do not impersonate another person, misrepresent a business, bypass access restrictions, or use an account to harm other users. You are responsible for your authorized activity on the service; nothing in these Terms removes rights you may have concerning unauthorized transactions.

Food Drops

Food drops may be available for a limited ordering period and may have quantity limits or a minimum needed for the drop to proceed. Availability can change, and a drop may not proceed if its requirements are not met. Review the listing, ordering deadline, quantity, and fulfillment information before ordering.

Current minimum progress is based on purchased units rather than the number of distinct customers. For example, three units purchased by one customer contribute three units toward the displayed minimum. Meeting a minimum does not mean the food has already been prepared or delivered.

Orders and Payments

Review the selected products, quantities, prices, and applicable service fees, delivery fees, discounts, and taxes shown during checkout. You are responsible for providing accurate payment and order information and for authorizing the payment you submit. Stripe processes payments for Kazzera.

Adding an item to your cart or starting checkout does not create a paid Order. When you complete payment through Stripe, Kazzera records a paid Order after receiving and validating successful payment information. Processing can take time. If you see a charge but cannot find the corresponding order, contact support before attempting another payment.

The current checkout collects payment when you complete the payment process, subject to payment processing and any required authentication. It does not wait for a food drop to reach its minimum. A paid Order is initially pending fulfillment; payment confirmation does not by itself confirm that a drop will proceed, that a creator has begun preparation, or that pickup or delivery is complete.

Cancellations, Failed Drops, and Refunds

If you need to cancel an order, a creator cannot fulfill it, or a drop does not proceed, contact Kazzera support with your order number, the creator’s name, and a description of the issue. A request for cancellation is not confirmation that an order has been canceled or a refund has been issued.

The current service does not automatically refund a payment simply because a drop misses its minimum or its ordering deadline passes. A charge can remain until it is separately resolved. Canceling or removing a listing is not the same as refunding its payments.

This description of the current process is not a no-refund policy and does not limit any refund or other remedy required by applicable law. No automatic refund timing, cancellation fee, or blanket refund entitlement is established by this section.

Founder/legal review required: finalize customer and creator cancellation rules, failed-drop resolution, refund eligibility, amounts (including fees and taxes), timing, notifications, and responsibility for issuing refunds. Confirm that operational procedures meet applicable obligations before treating this section as final.

Pickup and Delivery

Pickup and delivery options vary by creator and drop. Follow the location, timing, and instructions associated with your order. Provide accurate contact details, delivery addresses, and access instructions, and contact support if those details are incorrect or you cannot meet the stated arrangements.

Delivery may be performed by a creator or an assigned local delivery participant. Delivery is not available for every product or address. If a pickup or delivery is missed, delayed, or unsuccessful, contact support; these Terms do not establish an automatic forfeiture or refund rule for that situation.

Food and Allergen Responsibility

Creators are responsible for accurately describing their products, including ingredients and relevant allergen information, and for meeting legal requirements that apply to their food preparation and sales.

If you have an allergy or dietary restriction, verify ingredients and preparation practices directly with the creator before ordering. Do not assume that a product is allergen-free or suitable for a particular dietary or medical need based on its name, image, or category. Kazzera does not guarantee the absence of allergens or cross-contact.

Independent Creators

Creators operate their own food businesses and provide the products they list. They are responsible for their listings, preparation, fulfillment commitments, and applicable business requirements. Using Kazzera does not, by itself, establish an employment relationship with Kazzera.

Kazzera’s role includes providing marketplace and coordination tools. This description does not exclude responsibilities Kazzera may have under applicable law or a separate agreement.

Prohibited Conduct

Do not use Kazzera for unlawful activity, fraudulent orders or payments, harassment, threats, impersonation, or deceptive listings. Do not submit malicious software, interfere with the service, access information without authorization, or attempt to bypass security or account restrictions.

Do not misuse another person’s personal information, manipulate reviews or polls, abuse referral or promotional features, or infringe another person’s rights.

Intellectual Property

Kazzera and its licensors retain their rights in Kazzera branding, software, designs, and platform content. Using the service does not transfer ownership of those materials. Do not copy or use them beyond what is permitted by the service, applicable licenses, or law.

You retain your rights in content you submit. You must have the rights needed to submit it. By submitting content for use on Kazzera, you permit Kazzera to host, store, reproduce, format, and display it as needed to operate the features you use, including displaying published listings and community content. This permission does not transfer ownership of your content.

Reviews, Polls, and Community Content

Keep reviews, poll responses, comments, messages, and other contributions relevant and honest. Do not submit unlawful, abusive, fraudulent, or infringing content, disclose another person’s private information without authorization, or misrepresent your experience with an order or creator.

Community contributions reflect their authors’ views. A review, vote, or other contribution is not a guarantee about a product, creator, or future drop.

Service Availability

Kazzera may modify, suspend, or discontinue features, including when needed for maintenance, security, or legal reasons. Access may be interrupted by technical problems or provider outages. We do not promise that every feature or listing will always be available.

Changes to platform availability do not erase existing payment obligations or customer remedies required by law. Contact support about any outstanding order affected by a service interruption.

Disclaimer of Warranties

To the extent permitted by applicable law, the Kazzera platform is provided “as is” and “as available,” without a promise that it will be uninterrupted, error-free, or suitable for every purpose. We do not guarantee that a food drop will reach its minimum.

This disclaimer concerns the platform and does not remove statutory warranties, food-safety obligations, or other consumer protections that cannot lawfully be excluded.

Attorney review required: confirm the scope and enforceability of this disclaimer for Kazzera’s operating jurisdictions and marketplace responsibilities.

Limitation of Liability

To the extent permitted by law, Kazzera is not responsible for indirect or consequential losses, such as lost business opportunities, arising from use of the platform. This does not exclude liability for fraud, willful misconduct, or any liability that cannot lawfully be limited, and does not remove a customer’s right to a legally required refund or remedy.

Attorney review required: approve the allocation of marketplace risks and any liability exclusions or financial cap. No monetary liability cap has been selected in this draft.

Indemnification

To the extent permitted by law, you agree to reimburse Kazzera for reasonable losses and costs from a third-party claim caused by your unlawful conduct, infringement of another person’s rights, or material breach of these Terms. This applies only to the extent the claim is attributable to your conduct and does not require you to cover losses caused by Kazzera’s own wrongdoing.

Attorney review required: confirm whether and how indemnification should apply to customers, creators, and delivery participants, including notice and claim-handling procedures.

Governing Law

Nothing in these Terms removes mandatory protections that apply to you under applicable law.

TODO — Founder/legal confirmation required: identify the contracting legal entity and select the governing law and any appropriate dispute venue. No governing state, exclusive court, or arbitration requirement has been selected.

Changes to Terms

Kazzera may update these Terms as the service or applicable requirements change. The effective date identifies the version shown on this page. Changes are subject to any notice or consent requirements under applicable law and do not retroactively eliminate rights relating to an existing order.

Contact
